Domain & Content:
For us to host your website, it is necessary for you to upload your content to our servers. When you do this uploading, you are creating one or more copies of your content on our system. By purchasing hosting services from us, you acknowledge that these copies are being made, and give us the permission (a license) to maintain these copies and make them available to users of the Internet. You are solely responsible for providing all of the content and other data that make up your website.
Bandwidth Usage:
The Company provides Users with bandwidth, disk space and other resources, such as e-mail, mysql databases, and/or file-transfer-protocol (“FTP”) accounts, the amount of which is defined in The Company’s web pages describing the package of Services purchased at the time of purchase. In some cases, The Company may not establish a specific amount of bandwidth, disk space and other resources, and refer to that as “Unlimited”. In all cases, the Services are intended for normal use only, and any activity that results in excessive usage that is inconsistent with normal usage patterns is strictly prohibited. The Company reserves the right to suspend, discontinue or delete the accounts of Users whose use of disk space, bandwidth or other resources results in or presents the risk of degradation of service to other customers, regardless of the amount of disk space, bandwidth or other resources included in the User’s plan. User agrees that such usage shall not exceed the amounts set by The Company for the Services purchased (the “Agreed Usage”) and is additionally subject to normal usage guidelines established by The Company as in effect from time to time. User may not use 25% or more of system resources for longer than 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc. User also may not exceed the limit of 250,000 inodes on any shared account. Any accounts exceeding the inode limit will not be backed up. These allotments are optimized and dedicated towards serving the Content and User’s active electronic mail services related solely to User’s web hosting account(s) with The Company.
Hosting space is intended for normal use only, and is limited to Web files, active e-mail and content of the hosted Web sites, not for storage (whether of media, e-mails, or other data). Hosting space further may not be used as offsite storage of electronic files, electronic mail or FTP hosts. You are responsible for removing any files, e-mails or other data which do not meet these requirements, and for adhering to any usage requirements or limits allocated to your account(s). Failure to do so may result in removal and deletion of such materials (including without limitation files and e-mails), and/or in discontinuation of your services or account, which actions we may take in our sole discretion.
The Company will monitor User’s use of bandwidth, disk usage and other resources. The Company, in its sole discretion, shall have the right to take any corrective action if User’s utilization of bandwidth, disk usage or other resources exceeds the Agreed Usage, resource usage, or is used for other improper storage or usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services, removal or deletion of User’s Web site, User Content, User’s electronic mail and e-mail services and/or other materials and services or termination the User’s account and of this Agreement, which actions may be taken in The Company’s sole and absolute discretion.
Liability:
The Company makes no warranties or representations that any Service will be uninterrupted or error-free. Customer accepts all Services provided hereunder “as is” and “as available” without warranty of any kind. All implied conditions, warranties and terms (whether express or implied by statute, common law, custom or otherwise) – excluding those relating to the exercise of reasonable care and skill, fitness for purpose and satisfactory quality (where applicable) – are hereby excluded in relation to each of the Services to be provided hereunder to the fullest extent permitted by law. The Company shall not be liable for any services or products to be supplied by any third party. The Company shall not be liable for any loss or damage of whatsoever nature suffered by Customer arising out of or in connection with any breach of this Agreement by Customer or any act, misrepresentation, error or omission made by or on behalf of Customer. The Company is not responsible for any delay, malfunction, non performance and/or other degradation of performance of any of the Services caused by or resulting from any alteration, modification and/or amendments due to changes and specifications requested or implemented by the Customer whether or not beyond those already supplied.
Third Party Product Names:
The Company services are compatible with many software applications and third party products. The names of such products and/or applications are used on The Company website with descriptive purpose only. Such names are registered trademarks of third companies, from which The Company is entirely separate and independent, unless otherwise stated.
Acceptable Usage Policy:
The Company strives to maintain a high-level of service, and a lot of customers depend on our high standards of quality. As such, we will not provide services to those that are using our services for:
Hacking, which includes, for example penetrating or attempting to access, without authorization, another computer or network? Port scans, stealth scans, and fraudulent credit card “phishing” techniques are also prohibited.
Hosting of files or other data that infringes on another’s copyright or other intellectual property rights.
Spamming, or sending of bulk unsolicited email. We maintain a strict policy on spamming, which includes the sending of unauthorized commercial messages by use of our services, or by maintaining an open SMTP connection. We reserve the right to refuse or terminate service based on reasonable indications that you are engaged in spamming of any sort.
Uploading or linking to any content that violates another’s right of publicity or privacy. Distributing hate speech, or any other content that is obscene, abusing, which could be considered libellous and defamatory?
Hosting, storing, or distributing adult or child pornography is strictly forbidden. If any such content is found and brought to our attention, the proper law enforcement agencies will be notified and your account will be suspended. Hosting large amounts of data not specifically tied (“linked”) to your hosting account. The Company encourages users looking for file storage/backup solutions to seek other services that specialize in this.
Unlimited Policy:
What does “Unlimited” really mean?
Our WekLoo India customers need not to worry about the disk storage or network/file transfer when it gets popular in public.
But still you need to worry about certain things. When your website isn’t well optimized and have many issues for others on shared environment (Because it’s Repeated hitting on CPU, hogging RAM, or Lot of Disk I/O operations) you might be asked to sign up for virtual private servers.
Trust with us, every host have their same limitations… we’re just trying to be up front about them!
What’s not allowed in “Unlimited”?
Here are some specific things which are not allowed in WekLoo India Hosting:
- Pirated content which you don’t have the distribution rights.
- File uploading, sharing, archive, backup, mirroring, distribution, porn, abuse, spam contents.
- A site created primarily to drive traffic to another site like phishing activity.
- Making your account resources available to the public.
WekLoo India has the rights to delete these kinds of violating contents or operations in our servers in terms of Unlimited Policy. WekLoo India has sole decision to determine what does, and doesn’t violate either policy. We have zero tolerance against spamming and phishing activities on our servers. Hey, it doesn’t sound much “Unlimited” to me!
Legitimate Website Owner, for you, my host, it is unlimited.
All this terms and conditions applies to <.1% of people who want to try and run free porn affiliate sites or animated video trading forums or hosting pirated rips on WekLoo India that we aren’t having any.
Governing Law:
The Customer agrees that any claim or dispute you may have against WekLoo must be resolved by a court located in India without reference to any governing law rules that would result in the application of the substantive law of any other jurisdiction; The Customer hereby waives all rights to any kind of legal actions in any other court and/or under any other law except those of India; The Customer agrees to submit to the personal jurisdiction of the courts located within India for the purpose of litigating all such claims or disputes.
Billing: Company will generate a soft-copy of invoice in name of User/Reseller after service delivery.
Cases: All charges and taxes for any type of case are totally bearded by the Case Holder only.
Definitions of Incidents Reported: Company’s technical support analysts will determine the severity of any defect using the following priorities:
Severity 1 – “Fatal”
Errors that prevent useful work from being completed e.g. Server inaccessible.
Severity 2 – “Severe”
Errors that keep major functions from being performed but work around available e.g. Access to the server is slow, Time delay in response, Server accepts requests but not responding within acceptable time duration etc.
Severity 3 – “Minimal”
Errors those are generally non-disabling or cosmetic e.g. Service is not accessible to a particular subscriber, etc.
Severity 4 – “Other”
Errors or requests those are on business operations, e.g. Reconciliations, Logs etc.
Response and Resolution Times: Company’s support analysts will determine (depending upon) the severity of any incident and respond in one of the following (ways):
Severity 1 - Respond within 2 business hours to acknowledge and understand the Incident. Technical Support will work on the incident continuously until resolution. Periodic status updates will be communicated to the Client by phone / email. Target resolution or workaround time would be 4 hours during business hours from the time of response.
Severity 2 - Respond within 3 hours to acknowledge the problem. Target resolution or workaround time would be 8 hours during business hours from the time of response.
Severity 3 - Respond within 4 hours to acknowledge problem. Target resolution time or workaround time would be 16 working hours from the time of response.
Severity 4 – Respond within 8 hours to acknowledge problem. Target resolution time or workaround time would be 24 hours from the time of response. Till resolution, the case will be kept open.
Severity Level:
Company will process support requests, issue trouble ticket tracking numbers if necessary, determine the source of the problem, and respond to all support requests from Client Representatives based on the response times stated above.
These types of sites are not allowed on WekLoo:
- Adult Sites: concerning nudity in a sexual context, uncovered genitalia or adult themes
- Copyrighted Content: music, movies or games that you do not own the rights
- Hate Speech: content that promote aggression or incite hate against certain persons or group, such as race, religion, society, gender, or sexual orientation. The foregoing is examples, and not meant to constitute an exhaustive list of individuals or groups that may be the target of hate speech.
- SEO / Spam: a site whose only purpose is to gain Google page ranking, Facebook "likes", etc
- Phishing: a website supposed to trick users into provide their username and password and other personal information
- Illegal Content: content which may be prohibited in the INDIA or under the laws of other countries
- Scams: get rich quick type of scams, MLM, or other doubtful schemes
- Excessive Advertising: placing too much advertising on your site, including more than three ad units per page
- File Hosting: including websites that are not created with the WekLoo editor
- Injurious Experience: websites using the "HTML" part that gives a horrible user experience, such as excessive flashing banner or extreme animated movement
- Illegal/Wrong Products: websites that offer or sell items that are prohibited, weapons, forged, stolen, fake, infringing, violate rights of privacy/publicity, offensive, pornographic, or manufactured/intended to be weapons.

Without limiting the foregoing, WekLoo shall not be liable to you or your business for any incidental, consequential, special, or punitive damages or lost or imputed profits or royalties arising out of this agreement or any goods or services provided, whether for breach of warranty or any obligation arising there from or otherwise, whether liability is asserted in contract or tort (including negligence and strict product liability) and irrespective of whether you have been advised of the possibility of any such loss or damage. Each party hereby waives any claims that these exclusions deprive such party of an adequate remedy.
You acknowledge that third party product and service providers advertise their products and services on the WekLoo web site. WekLoo forms partnerships or alliances with some of these vendors from time to time in order to facilitate the provision of these products and services to you. However, you acknowledge and agree that at no time is WekLoo making any representation or warranty regarding any third party’s products or services, nor will WekLoo be liable to you or any third party for any claims arising from or in connection with such third party products and services. You hereby disclaim and waive any rights and claims you may have against WekLoo with respect to third party products and services, to the maximum extent permitted by law.
